Dynamic Radio Systems

Terms of Service

Effective October 26, 2026

These terms are an agreement between Dynamic Radio Systems ("we", "us"), a sole proprietorship, and the business or person using our service ("you"). By using the service, including the dashboard, alerts or summaries, you agree to these terms and to our Privacy Policy. If you are accepting for a business, you confirm you are authorized to bind it.

This is not a safety-of-life service. Dynamic Radio Systems does not replace a proper radio watch, is not affiliated with the U.S. Coast Guard, and does not relay distress calls to anyone. Alerts can be late, wrong, or not sent at all: receivers go offline, radio reception is imperfect, and automated transcription and analysis make mistakes. Never rely on the service to learn about an emergency. In an emergency, use VHF channel 16 or call 911.

1. The service

We operate radio receivers that pick up public marine VHF voice traffic. We record and transcribe it, analyze it automatically, and provide customers with alerts, summaries and a searchable archive based on the channels and settings they choose. We may change, add or remove features, and we will tell you in advance about changes that materially reduce what you are paying for.

2. Accounts

3. Text message terms

These terms apply to the Dynamic Radio Systems Alerts text messaging program.

4. Fees

Fees, billing periods and any trial are set out in your order or invoice. Unless that says otherwise, fees are billed in advance, are non-refundable, and the service may be suspended if payment is more than 30 days late. We will give at least 30 days' notice of any price increase.

5. Acceptable use

You agree not to:

6. Radio content

Radio transmissions are made by third parties, not by us or by you. We do not control what they say and make no promise that it is accurate, complete or lawful. Transcripts and summaries are produced automatically and may be wrong; when it matters, listen to the original audio. You are responsible for how you use radio content, including complying with any law that applies to using or disclosing radio communications.

7. Your content

You keep ownership of the settings, keywords and instructions you give us. You allow us to use them to provide and improve the service for you. We may use aggregated, de-identified information about how the service is used to improve it.

8. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY TRANSMISSION WILL BE RECEIVED, TRANSCRIBED CORRECTLY OR ALERTED ON.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS, OR FOR ANY LOSS ARISING FROM A MISSED, DELAYED OR INACCURATE ALERT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

10. Indemnity

You agree to defend and indemnify us against claims by third parties arising from your use of the service in breach of these terms or the law, including your use or disclosure of radio content.

11. Ending the agreement

You may cancel at any time by emailing us; cancellation takes effect at the end of the current billing period. We may suspend or end your access if you breach these terms, or end the service with 30 days' notice and a refund of any prepaid fees for the unused period. Sections 6 through 13 survive the end of this agreement.

12. Governing law

These terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Maryland, and both parties consent to their jurisdiction.

13. General

If we update these terms, we will change the date above and notify customers by email at least 30 days before material changes take effect; continuing to use the service after that means you accept them. If any part of these terms is unenforceable, the rest remains in effect. These terms, together with any order or invoice, are the entire agreement between us about the service. Neither party is responsible for delays caused by events beyond its reasonable control.
